A defendant's juvenile conviction for robbery does not count as a predicate offense towards finding him a "violent felon" under the Armed Career Criminal Act if his guilty plea didn't establish he used a firearm, the Second Circuit ruled recently.
After officers searched the defendant's home and found several weapons and ammunition, the defendant was charged with being a felon in possession. In addition to two violent felonies committed as an adult, the government argued that a guilty plea he entered as a juvenile qualified as a violent felony under the Armed Career Criminal Act and he should receive the mandatory minimum sentence of 15 years.See the full content of this document
