Lawsuit Against Attica School District Goes Forward

Summary


In a lawsuit filed by a group of parents who alleged Attica Central Schools was not providing an appropriate education to their children - many of them who are disabled - the U.S. Court of Appeals, Second Circuit, determined it was permissible for the plaintiffs to bypass the school district's administrative review process by bringing their claims directly to federal court.

In affirming the U.S. District Court for the Western District of New York's decision to deny Attica's motion to dismiss the plaintiffs' claims, the Second Circuit in J.S., by his parent and natural guardian, et al. v. Attica Central Schools, determined since the allegations against the school district involved systemic problems, it would have been futile for the plaintiffs to go through the administrative review process.
