Where the police, upon execution of a search warrant, discovered marijuana in the defendant's bedroom, the defendant was charged with Criminal Possession of Marijuana in the Fifth Degree and she moved to dismiss the accusatory instrument as being insufficient on its face.

Reviewing the facts in People v. Therese Castner, Webster Town Court Judge Thomas J. DiSalvo denied the defendant's motion. The court determined the police had reasonable cause to believe that the defendant committed the offense charged.
