New York Court of Appeals Approves Use of Eminent Domain

Summary


The use of eminent domain to build a 22-acre stadium project in central Brooklyn was approved by the Court of Appeals in a split decision issued Nov. 24. In the Matter of Goldstein v. New York State Urban Development Corporation, d/b/a Empire State Development Corp., No. 178.

The Court of Appeals upheld the Empire State Development's eminent domain power to take several privately-owned properties in central Brooklyn for inclusion in a 22-acre mixed-use project by private developer Bruce Ratner and his company, Forest City Ratner Companies.
