New York Court of Appeals Weighing Whether Acquittal Was Implied
A unique case is pending before the Court of Appeals which is considering whether an acquittal was implied when a jury considered two inconsistent second-degree murder counts, finding guilty on one and not specifically specifying the other. The defense maintains an acquittal of the latter charge was implied while the prosecution maintains the man could be tried on the other charge, which he was, and that that conviction should stand.
New York Ag Announces $54m Settlement Against Illinois-Based Pharmaceutical Giant
Two separate settlements with Illinois-based pharmaceutical giant Abbott Laboratories were announced Monday by Attorney General Eric T. Schneiderman. The cases involve the marketing and sale of the anti-seizure drug Depakote for unapproved uses. The first is a $1.5 billion global settlement with other states and the federal government to settle civil and criminal allegations that Abbott Laboratories illegally marketed Depakote. Vlsp Volunteer Attorney Honored by New York State Bar Association
Rochester attorney Lucien A. Morin II was honored last week when the New York State Bar Association presented its 2012 President's Pro Bono Service Awards at its annual Law Day luncheon at the State Bar Center in Albany. Lucien, a partner at McConville, Considine, Cooman & Morin PC, was nominated by Sheila A. Gaddis, executive director of Volunteer Legal Services Project of Monroe County Inc.
Bar Exam Results Posted by New York Board of Law Examiners
Grading has been completed for the February 2012 bar examination, as announced last week by the state Board of Law Examiners. The board examined 4,011 candidates during the two days of testing on Feb. 27 and 28. Graduates of law schools accredited by the American Bar Association who took the bar examination for the first time achieved a passing rate of 69 percent.
Erdman Anthony is the recipient of two American Council of Engineering Companies New York Engineering Excellence Awards. The firm garnered a gold award for an improvement project on Interstate 490 and a silver award for its scan and model of the entire interior of New York City's Radio City Music Hall.
America Invents Act Discussion to Be Held in Rochester
Two Atlanta attorneys will be in Rochester on Thursday to talk about "The Effect of the America Invents Act on Small Businesses." The lecture will be presented by J. Gibson Lanier, an associate in the Intellectual Property and Patent Group at Ballard Spahr LLP, and David Perryman, of counsel, Intellectual Property Life Sciences/ Technology Patents and Transactional Finance Group, with the same firm, which has several offices across the U.S.
