Western District of N.Y. Court Rules Against Building Owner and in Favor of Insurance Company

In a case where the plaintiff's building was found to be contaminated with mold, the U.S. District Court for the Western District of New York determined the insurance company was not obligated to indemnify the plaintiff. In granting the insurance company's motion for summary judgment, Judge William M. Skretny in 40 Gardenville, LLC v. Travelers Property Casualty of America found the insurance policy expressly stated it did not cover losses caused by dampness.

N.Y. State Court of Appeals Rules Representation of Defendant Deemed Effective

Matrimonial Commission to Hold Hearing in Buffalo On April 21

The Matrimonial Commission, appointed by New York State Chief Judge Judith Kaye to examine every facet of the divorce process in the state and recommend reforms, will hold a public hearing in Buffalo. The hearing is set for 9 a.m. to 6 p.m. on Thursday, April 21 at the Erie County Courthouse, ceremonial courtroom, 92 Franklin St. The commission is seeking testimony from individuals and organizations regarding ways to reduce costs, delays and trauma to the parties involved in divorce proceedings.

New York State Legislature Acts to Strengthen Megan's Law

Senate Majority Leader Joseph L. Bruno and Deputy Majority Leader Dean G.
